The Downtown Houston restaurant owned by NBA player James Harden is now facing serious legal trouble concerning a fatal car crash that killed seven people last year.

According to the Houston Chronicle, the family of Taylar Jackson is suing Harden’s restaurant, Thirteen, and its parent company, Team Harden LLC, and announced that they were seeking over $1 million in damages. The suit, filed on Friday (Dec. 6), accuses the restaurant of overserving the man responsible for the wreck.

Seven people died as a result, including Jackson and former NFL/University of Houston player D.J. Hayden.

Jackson was a passenger in the SUV with Hayden and four others that was T-boned by a speeding Chrysler 300 at the intersection of Fannin and Pierce on Nov. 11, 2023. The sedan ran a red light before hitting the SUV, according to authorities. The vehicles then careened into a nearby underpass, killing a homeless man.

The driver, Christian Herrera, 25, was among the people killed.

Jackson was rushed to a local hospital in critical condition. She died from her injuries on April 29, six months after the crash.

While police did not name the restaurant in connection to the crash, the lawsuit claims that Herrera was drinking there before the crash. Employees allegedly served Herrera “when he was obviously intoxicated to the extent that he presented a clear danger to himself and to others,” according to the suit.

On Monday (Dec. 9), a spokesman for the Houston Police Department confirmed that its investigation into the crash closed eight months ago. The spokesman said that the Texas Alcoholic Beverage Commission also investigated.  However, the commission “did not find sufficient evidence of a violation on the business’ part.”

No other lawsuits have been filed against the restaurant in connection to the crash.
